I’ve been asked about posting notice for the Illinois Employee Classification Act.  For  more information about the Act, see my 2/10/08 post.

This is a simple provision of the Act.  It’s contained in Section 15 Notice.  All businesses with “one or more individuals perform[ing] services who are not classified as employees under . . . this Act shall post . . . in a conspicuous place on each job site wehre those individuals perform services and in each of its offices, a notice in English, Spanish, and Polish, prepared by the Department [Illinois Department of Labor], summarizing the requirements of this Act.  The Department shall furnish copies of summaries without charge to entities upon request.”

Per the Department of Labor’s proposed rules, Section 240.410, if it’s “not practicable post a notice on the job site, notices shall be provided to all individuals performing services who are not classified as employees.”

The notice is titled:  “NOTICE TO INDIVIDUALS PERFORMING SERVICES FOR CONSTRUCTION CONTRACTORS.”  It’s a single sheet poster (with the English, Spanish, and Polish versions all on one sheet).  This poster is available on the IDOL’s website at http://www.state.il.us/Agency/IDOL/FORMS/PDFS/ECA3in1.PDF.  If the link is broken, you can also get the poster here on my site–just click Employee Classification Act 3-in-1 Poster 2008 from Illinois Department of Labor.  I’ve got your back!
